Maintenance

A person has a right to the fundamental necessities of life, including food, clothes, housing, and other necessities for a decent existence. According to the social justice principles, it is a man's inherent obligation to pay maintenance to his wife, parents, and children in order to provide for their needs.

According to India's maintenance law, a man has a responsibility to support his wife, children, and parents when they are unable to support themselves. The sum paid to the dependent wife, child, or parents to support themselves is known as maintenance in law. Either a single lump sum payment or monthly installments are acceptable ways to pay the money.

Maintenance

The notion of maintenance is outlined in Section 125 of the Code of Criminal Procedure, 1973, together with the other personal laws that extend the right to maintenance to not only the wife but also to her parents and children.

While those individuals are subject to the personal maintenance laws of India, anyone may submit a maintenance claim under Section 125 of the CrPC regardless of religion or caste. The Indian maintenance law specifies the steps to be taken in order to request support for both a wife and a kid.
